
I was on the record as stating that Justice Ginsburg would leave us before the election.
Can’t say I’m happy about the timing though.
Normally the process of appointing a Supreme Court Justice takes 60 days and as of this writing we go to the polls in 46 days.
If President Trump ramrods this, it will take a huge chunk out his campaigning time. If he waits until after the election he can only be certain of a Republican majority in the Senate (such as it is) until Jan 2, 2021.
Scenario: Trump Waits
There is nothing the Democrats can do to prevent Trump from nominating a Justice. But the majority is super slim and three of them are RINOs. They could easily cross the aisle and say the matter should be taken up by the next congress.
The Left has no love at all for Joe Biden. I’ve never seen a candidate with less enthusiasm from the Left to include Walter Mondale. But holding on to her seat in the Supremes will get their motors running like nothing else.
Scenario: Trump Pushes Forward
Losing her seat to the our side this close to the election will give them the “Broken Glass” advantage. As in “I will crawl a mile over broken glass to pull the lever against him.”
Or they might go into despair if it shifts to 6 to 3.
This morning I was certain that Trump would win and there is still no reason to think that his advantages vanished.
But Ginsburg’s death is now a loose canon on the deck.
I suspect we will know the president is going to do by Monday.

SECOND UPDATE: Trump is going for it. “We were put in this position of power and importance to make decisions for the people who so proudly elected us, the most important of which has long been considered to be the selection of United States Supreme Court Justices. We have this obligation, without delay!.”
With the fuzzy picture on the main page, I thought it was Quark at first and we were getting a Star Trek post.
I don’t know if they can amp it up more. Everyone knew Trump was going to get at least one more SCOTUS pick if he won re-election. The people most emotional about it were going to vote against the OrangeMan anyways.
If he wants to ramrod it through, he picks Ted Cruz. Most of the Senate would be happy to see him leave and he’s been in the public eye forever. Plus, if he can push Cruz through the nomination process, a lot of Dems will decide the deed is done. Why worry about Biden at that point?
